REFUND AND RETURN POLICY
As flower bouquets and arrangements are perishable products, we adhere to a strict refund and return policy as it concerns the quality of the materials used - this means that an issue of "not liking" the arrangement sent/received is NOT grounds for any reimbursement.
For in store pickups, any and all issues on design choices must be stated at the time of purchase. We will firstly ask how the arrangement looks to you and if you are pleased with the design. We will again ask if there is anything you would like adjusted, substituted or removed before we process payment. If you affirm the design on pickup before payment, any further recourse after the design is taken from the studio is null and void.
Any and all issues of quality after receiving a Crown Heritage design through delivery means must be reported to us with 24 hours of delivery via email with a detailed description of the issue experienced AND photographic evidence, NO EXCEPTIONS. We will contact you at the earliest convenience to resolve the issue and will happily replace any item damaged or below our highest of standards in quality.
Proper care must be undertaken by the recipient to maintain the integrity of their flower design - this includes changing the water, trimming the stems and providing a clean vase. Failure to do so by the recipient is not subject to ANY reimbursement.
For any disputes that may involve monetary reimbursement, claims must be made by the sender. We will NOT engage in any resolution that involves financial compensation with the recipient of a Crown Heritage design, including store credit.
Limitation of Liability
Under no circumstances will Crown Heritage Flowers LLC be liable to you for any loss or damages of any kind directly or indirectly related to: (1) our website, (2) any content on our website, (3) your use of, inability to use, or the performance of our website, (4) any action taken in connection with an investigation by law enforcement authorities regarding yours or any other party's use of our website, (5) any action taken in connection with copyright or other intellectual property owners, (6) any errors or omissions in the website's operations, or (7) any damage to any user's computer, mobile device, or other equipment or technology including without limitation, damage from any security breach or from any virus, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure and any or all other technical or other malfunction. Such losses or damages include, without limitation, damages for lost profits, loss of goodwill, loss of data, work stoppage, accuracy of results or computer failure or malfunction, even if foreseeable or even if Crown Heritage Flowers LLC have been advised of or should have known of the possibility of such damages, whether in an action of contract, negligence, strict liability or tort. In no event will Crown Heritage Flowers LLC be liable to you or anyone else for loss, damage or injury, including without limitation, death or personal injury. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event, will the Crown Heritage Flowers LLC total liability to you for all damages, losses or causes or action exceed the total amount that you have spent with the business within the present calendar year.
You agree that in the event you incur any damages, losses or injuries that arise out of Crown Heritage Flowers LLC's acts or omissions, the damages if any, caused to your are not irreparable or sufficient to entitle you to an injunction preventing any exploitation of the website, a service, all property, any products or other content owned or controlled by the Crown Heritage Flowers LLC party, and you will have no rights to enjoin or restrain the development, production, distribution, advertising, exhibition or exploration of any and all Crown Heritage Flowers LLC holdings.
You agree to defend (at Crown Heritage Flowers LLC’s request), to indemnify and to hold harmless Crown Heritage Flowers LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorney’s fees and costs, arising out of or in any way connected with any of the following (including as a result of your direct activities on the website or those conducted on your behalf both online and in store): (i) your content or your access to or use of the website; (ii) your breach or alleged breach of this agreement; (iii) your violation of any third-party right, including without limitation, any intellectual property right, publicity, confidentiality, property or privacy right; (iv) your violation of any laws, rules, regulations, codes, statutes, ordinances or orders of any governmental and quasi-governmental authorities, including, without limitation, all regulatory, administrative and legislative authorities; or (v) any misrepresentation made by you. You will cooperate as fully as required by Crown Heritage Flowers LLC in the defense of any claim. Crown Heritage Flowers LLC reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you will not in any event settle any claim without the prior written consent of Crown Heritage Flowers LLC.
